Terms and Conditions

Definitions - "THE BUSINESS” means Gaby and Chic, LLC. 
"THE HIRER" means the person who hire the equipment for a period of time and price. 
"THE EQUIPMENT" means all the goods hired for the event contracted. 
"THE AGREEMENT” means the agreement between the Business and Hirer whereby the Business, owner of the Equipment allows the Hirer, to hire the Equipment for a period of time by paying a price.

 

Agreement - The Hirer, by placing an order via email or telephone, agrees that they accept the conditions of the hiring agreement. The Business will retain a booking form and signed terms and conditions agreement, which the Hirer will then be supplied an invoice as confirmation of their booking.

 

Hiring Charges - Charges are for a 24-hour period. The hiring charges are for the agreed period. If the equipment is unavailable for pick up or return, The Business reserves the right to charge the Hirer for extra time as per the 24 hour rate.

 

Cancellation -  If the Hirer cancels the booking more than 7 days in advance of the booked delivery date, the Business may retain 50% of security deposit. If the Hirer cancels the booking less than 7 days in advance of the booked delivery date, the full amount of the invoice shall be due to the Business. In the event that the Hirer is liable for 100% of the invoiced amount, the Hirer may work with the Business to reschedule the delivery date to another date in the future.

 

Payment - Bookings are held upon request and are subject to availability and confirmed once booking form is received and The Business has invoiced the Hirer. $150 deposit is required to secure your booking and full payment required 7 days prior to event date. The Business reserves the right to cancel the event if full payment has not been received 7 days prior to delivery.

 

Delivery and Pickup - All distances are measured from NC ZIP code 27516. No delivery fees are charged if the event occurs within 20 miles distance; between 20 and 30 miles, a delivery fee of $25 will be charged. We can´t service events further away than 30 miles.

Set up and Pick Up times will be from 10am - 2pm and you will be allocated a 2 hour window for arrival.  Alternate times can be discussed on request and subject to availability.

Positioning / Setting up of Equipment. - The Hirer is responsible for indicating clearly the location of the assembly or dismantling of the equipment. The Business will take every care, but shall not be liable for any damage to the site, site access, furniture or personal belongings. All the equipment requires that the designated areas be cleared of furniture and floors are clean before setup commences. The Business reserves the right to forfeit the booking upon arrival to the property if the equipment could be compromised or damaged due to unhygienic living conditions. No refund will be granted.

 

Use of Equipment - The Hirer is responsible for checking the quantity of hired items against the invoice/agreement upon delivery and should contact the Business immediately to advice of any discrepancy or damage discovered. Advice after the event will not be considered as advice and the Hirer will be, liable for any loss or damage to the Equipment. Damage to hire equipment during use is the responsibility of the Hirer and the Hirer agrees that repair or replacement charges for damaged equipment will be actioned after the hire date. If at any time during the hire period the Hirer considers the equipment to be faulty, it is the Hirers responsibility to contact The Business by telephone to report the problem. The Business reserves the right to repair or replace the faulty equipment as soon as practicable during the hire period to the reasonable satisfaction of the Hirer. The Hirer should not attempt to repair the Equipment without prior consent of the Business. Call out charges, relative to the time of day, will be due and payable if the equipment is found not to be faulty as claimed by the Hirer. The Business will not be liable for any loss, damage or expenditure incurred by the Hirer due to faulty Equipment for any reason whatsoever.

 

Cleaning - No cleaning charge will be applied to all equipment, however if they are returned stained or excessively dirty replacement charges will apply. All hire equipment, linen and bed sheets need to be returned dry.

 

Environment - Strictly NO PETS are permitted on any hire property due to hygienic purposes. If animals are sighted on our equipment or pet hair is found on bedding, an automatic loss of the deposit will apply. All parties must be in SMOKE-FREE environments. The Business reserves the right to forfeit your deposit without refund if staff finds your property to contain cigarette smoke odor. NO FOOD is allowed into the tents.

 

Insurance - Insurance is the Hirer’s responsibility during the hire period. The Hirer is responsible for the security of the equipment at all times during the Hire period. Any lost, broken, damaged or destroyed equipment will be charged to the Hirer at full replacement value.

 

Liability to Third Parties - It is responsibility of the Hirer to take care and always supervise children with hire equipment. Diligence must be taken with younger children on the customer’s premises. The Business will not be responsible for any injuries or physical damages due to utilizing equipment rentals.

 

The Business will not be responsible for any injury, illness, death, loss, damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:

 

i) The fault of the person(s) affected or any member(s) of his/her party or
ii) The fault of a third party not connected with the provision of your placement which we could not have predicted or avoided or
iii)  An event or circumstance which we or the supplier of the service(s) in question could not have predicted or avoided even after taking all reasonable care
